PRIVACY NOTICE
This agreement contains the complete terms and conditions that apply to your participation as a customer of JSPECMOTORSPORT. By making a purchase, you are confirming that you have read this agreement and you agree to be bound by the terms and conditions contained in this Agreement. Please read carefully before proceeding to purchase. All sales are final and all products sold by JSPECMOTORSPORT, are sold "as is" to the Buyer.
1. You hereby agree to indemnify and hold harmless JSPECMOTORSPORT, and its subsidiaries, and their respective directors, officers, employees, agents, partners, members, and other owners, against any and all claims, actions, demands, liabilities, losses, damages, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) (any or all of the foregoing hereinafter referred to as "Losses") from any damages (whether physical or psychological), injuries, permanent disabilities or deaths caused directly or indirectly by any of our products or services.
2. All automobile parts should be installed by a professional mechanic in a properly equipped workshop. Any damaged or missing parts during installation will not be refunded, nor any request for such be entertained. All advices and technical information provided by us will be used under your own discretions. We will not bear any responsibilities for any misunderstanding and misinterpretation. Body Kit/ Aero-Dynamics: Buyer fully understands that all body kits are sold "as is" with no warranty expressed or implied; due to the fact that most body kits are made of 100% fiberglass. Buyer also understands that due to strict U.S. Federal and State Safety crash guidelines, JSPECMOTORSPORT is not responsible or liable for any damages or possible injury incurred upon possible accidents due to driver error, incorrect installations, bad judgment (cracking or breaking your aero parts) or act of nature, etc... All body kits (aero components) are only recommended and legal to be used for off-highway use such as track racing or for exhibition show only! Buyer understands that all body kits (aero components) may need modifications for correct fitment such as removal of safety reinforcements, removal of factory bumper lights/side marker indicators, shaving, molding, etc. Because some of these kits may be prototyped and are used only on Japan Domestic Market vehicles that may have less safety standards/requirements than other countries. Buyer understands that all body kits (aero components) require some prep work before paint; we are not responsible for any extra incurred fees, material fees, storage fees for unexpected labor your body shop/paint shop charges the Buyer.
3. All advices and technical information provided by us will be used under your own discretions. We will not bear any responsibilities for any misunderstanding and misinterpretation.
4. JSPECMOTORSPORT does not guarantee the legality of any products we sell. It is the customer's responsibility to check local and state laws regarding vehicle modification before ordering. Some parts we sell are for racing only, and are not legal for use on public road or street. All engine modification components, except those that are exempt, have been designed and are intended for off-highway application. Many state laws prohibit the removal, modification, or rendering inoperable of any device or element of design affecting vehicle emission or safety in a vehicle used on public highways. Violation of such laws may subject the owner or user to a fine or penalty. Installation of this part may void the warranty coverage, if any, on your vehicle. Vehicles modified by the use of performance parts may no longer be lawfully used on public highways.
5. We reserved the rights to modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion, by posting a change notice or a new agreement on this site. Modifications may include, for example, changes in the scope of membership or dealer programs, payment procedures and rules.
6. Governing Law: This Agreement will be governed by the laws of the United States of America, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the federal or state courts located in the county of Santa Clara, California, and you irrevocably consent to the jurisdiction of such courts. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such a provision or any other provision of this Agreement and that you have accepted these terms and wish to register as an end user with us.
7.
All purchases will be held through Paypal. Purchases
may incur a 3% surcharge for Credit Card usage. Purchasing thru the www.JSPECMOTORSPORT.com
authorizes a 3% surcharge for all purchases.
8. A
tax rate of 8.25% will be added to the sales order amount for residents
who reside in California.
9. It
is to our sole discretion in selecting the shipping carrier whether through
UPS, US Postal, Fed-Ex, and etc.
10. All
prices and discounts are subject to change without notice. All merchandise
information marked on our website is and were true and correct at the time
of publication.
11. All used products
sold are final and all used products sold by JSPECMOTORSPORT, are sold "as
is" to the Buyer.

(IN STOCK) products means that we currently have them
in stock at our warehouse. (ORDER) products means that the item is available
but will have to be special ordered. expected time of delivery will be given
through Email.
SHIPPING AND RETURNS
Shipping Errors:
If you think that we have shipped the items wrongly to you, please contact us within 72 hours of receiving your package for our verifications of the item sent. If error has been established to be from JSPECMOTORSPORT, we will arrange for pickup and re-shipment of correct parts to you at no additional charge.
Damage Claims:
All products are shipped using carrier-approved materials and methods. All merchandise are also carefully packed to prevent damage during shipments. Nevertheless, damage may occur in transit. Any damage in shipment is the responsibility of the carrier, therefore all damage claims must be made by the purchaser directly to the carrier and are subjective to the Carrier's liability clause. All products shipped by JSPECMOTORSPORT are insured. In case of damage, retain all carton , packing materials and damaged merchandises for the carrier's representative of your area to inspect. If the damage is apparent upon receipt, accept the merchandise and note the damage and irregularities (such as crushed, torn or broken packing) on the freight bill and have the driver sign it as verification. If the damage is not readily apparent at the time of arrival , then it must be reported to the shipping company within 24 working hours after receipt of shipment. After inspecting the damaged merchandise, the carrier will determine whether to pay for repair costs or replacement value of the damaged goods. Repair cost is an arbitrary amount which can be negotiated with the carrier in the event of disagreement. All disputes as to the settlement amount or manner should be addressed with the carrier. JSPECMOTORSPORT shall under no circumstances be liable for the damaged merchandise or for subsequent settlement of the claim with the carrier. However, as a courtesy, if you need assistance with a claim. We would be glad to help you in reaching an amicable settlement with the carrier.
Cancellation and Return Policy:
By accepting our shipping quotations and the shipping dates, you have agreed to abide by our sales' terms and conditions set forth in this purchase order. Any orders once confirmed after shipping charges and Shipping dates has been accepted, cannot be cancelled. Please understand that we have to order immediately with the manufacturer once we have received your confirmation of order, and that we are also subjected to the same non cancellation rules. We are unable to assist those who wish to return the goods because they have purchased the wrong items. It is the end-users responsibility to make sure that they are ordering the correct part for the correct application. All sales are final. There is a no refund or exchange policy on all special orders. All items not in stock at our facility, JSPECMOTORSPORT, are considered special order items. Please understand that many of these items are custom specified by you as the purchaser and would therefore not be usable by another end user. If JSPECMOTORSPORT chooses to honor an exchange policy, the end user will be responsible for a 20% restocking fee of the full purchase price of the item being exchanged The end user will also be responsible for inbound freight to JSPECMOTORSPORT, as well as outbound freight to its final destination. Customer will also be responsible for any outstanding balances which may be due for the replacement product.
ORDER CONFIRMAITON
All orders placed with JSPECMOTORSPORT constitute the acknowledgement and acceptance of all conditions listed below. All parts or items ordered shall remain the property of JSPECMOTORSPORT until paid for in full. Depending on the product(s) ordered and the destination of the order, certain shipping services may not be available. JSPECMOTORSPORT reserves the right to change the method of shipping suited to the product(s) ordered and the destination of the package(s).
Backorders:
If JSPECMOTORSPORT is unable to immediately fill the entire order, the balance of the shipment will be placed on back order. Parts in stock will be sent immediately when the stock are available. Back order items will be shipped at the earliest possible date when it is available and the shipping method used will be at the discretion of JSPECMOTORSPORT and additional charges will be at the expense of the buyers. However, we at JSPECMOTORSPORT, will always find the most economical and fastest shipping methods for our customers.
Warranty Disclaimer:
All purchases from JSPECMOTORSPORT are sold "As is" without any product warranties of any kind. All implied warranties, including all warranties of merchantability of fitness or performance for a particular or specific purpose, are excluded. All customers must acknowledge that no legal representations can be made regarding all products purchased from JSPECMOTORSPORT, including, but not limited to any legal representations as to its product's quality or performance. All customers shall be responsible for, and bear all cost of repair and/or replacement (if entitled to) due to any defects in, or failure of, any products purchased from JSPECMOTORSPORT. All customers must also acknowledge that there will be no warranty coverage for any products that failed, be it in the product's functionality, or in the product's performance, as a result of the customer's own installation, or the result of the customer's appointed installer's installation. All customers will have to accept all responsibilities & liabilities for all vehicle modifications, and all potential risks related & associated to the said vehicle modifications.
Import tax:
For different countries, there will a different import tax for automobile parts. In most countries, import taxes are charged accordingly to the total amount base on our shipping invoices declared to your local Custom, which is Printed by our company. The end user is responsible for all import taxes which may be due by their country. JSPECMOTORSPORT, is not responsible or liable for any import taxes or duties required by the End Users country of residence or origin.
Product Specifications:
All prices, materials, design, color, contents including product's specification are subjected to change without notice. Some Product images may be shown with optional items that are sold separately. We reserve all rights for any printing or typographical errors on pricing or merchandise part numbers or details. By reading this, Customers shall exonerate all claims against JSPECMOTORSPORT for the ommissions. Therefore Customers are advised to check carefully before making a confirm purchase. Actual product shipped may differ from actual pictures displayed on website.
